The 14-year-old student who was caught with a gun in his backpack in the parking lot at Volcano Vista High School in May was not arrested.
According to the Albuquerque Journal, an Albuquerque police officer deferred to the state Juvenile Probation-Parole Office on the handling of the situation. A JPPO officer told the Albuquerque officer that the teen was a Level 3 “low risk” and “was not to be arrested.”
The incident happened on May 24, the same day as the shooting at Robb Elementary School in Uvalde, Texas, that left 19 students and two teachers dead.
After the gun was confiscated at Volcano Vista, principal Melissa Sedillo posted on Facebook that the student was arrested and is facing criminal charges.
While the student was only detained and not arrested, it is unclear if he is facing criminal charges. The gun was fitted with an extended magazine full of hollow point bullets.
“The actions of the Albuquerque Public School, the Albuquerque Police Department and CYFD is very concerning,” said Carlos Tenorio, a recent graduate of Volcano Vista. “I salute and applaud the quick and swift action of the Volcano Vista Security, Dean of Discipline and the entire Volcano Vista administration in ensuring that all students where kept safe. The administration and security did all they could to ensure that this individual was held accountable for his actions. Sadly, the APS district and APD have failed the community in not following through with the arrest of this individual.”
