Southwest Aeronautics, Mathematics and Science Academy (SAMS) filed a lawsuit against the Ventana Ranch Community Association last week for a quiet title on the SAMS property being built on Irving.

Members of the VRCA received an email containing the lawsuit and a link to the summons but do not need to respond or answer the complaint.

According to the VRCA, “20 plus years ago the property was deeded to one of the developers, however there was a problem, unknown until now,  with the order documents were filed. The Association has never claimed the property and was unaware of the title problem. The Board acknowledged that the Association had no interest in the property and have never claimed it as part of the Association. But the school decided to file a lawsuit to assure themselves they had clear title. They then decided that all members of the Association should be served, which probably was not necessary. But here we are.”

The lawsuit reads:

“Dear Homeowner:

Greetings.  You are receiving this email because it is believed that you are or may be a member of the Ventana Ranch Community Association (“VRCA”). If you are not a member of the VRCA, then please let us know, and you may disregard this letter and its contents. CRT Law & Professional Services, LLC represents RM SAMS, LLC in the above captioned matter, which is attempting to quiet title as to the Property where the facility is being constructed (the “Litigation”). Attached is a link containing the Summons, First Amended Complaint and its accompanying exhibits, Arbitration Certificate and the Order regarding the Litigation authorizing and directing this service.”
